1. About These Terms

These Terms of Use ("Terms") govern your access to and use of the BR mobile application ("App") and all related services, websites, and content provided by Beyond Relations LTD ("Company", "we", "our", or "us"), a company registered in the United Kingdom, and its director Yasin Uysal.

By creating an account or using the App in any way, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

2. Description of Service

BR is an AI-powered social media content generation platform that creates marketing content for businesses, including scheduled posts, captions, and image suggestions. The App connects to third-party platforms, including Instagram and Facebook, where permitted by the user.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, without notice and without liability to you.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

We reserve the right to terminate or suspend any account at any time, at our sole discretion, for any reason or no reason, without prior notice and without liability.

4. User Content

You retain ownership of any photos, text, audio recordings, and other materials you upload to the App ("User Content"). By uploading User Content, you grant Beyond Relations LTD a worldwide, royalty-free, non-exclusive licence to store, process, display, and use your User Content solely for the purpose of providing and improving the service.

You represent and warrant that you own or have the necessary rights to all User Content you submit, and that your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

We are not responsible for any User Content submitted by you or any other user. We do not verify, endorse, or take responsibility for the accuracy, completeness, or legality of User Content.

5. AI-Generated Content

The App uses artificial intelligence to generate content including images, captions, and post suggestions ("AI Content"). AI Content is generated automatically and may not always be accurate, appropriate, or suitable for your specific needs.

You acknowledge that AI Content is provided on an "as is" basis. Beyond Relations LTD and its director Yasin Uysal make no representations or warranties of any kind regarding the accuracy, quality, suitability, or fitness for any particular purpose of AI-generated content.

You are solely responsible for reviewing, editing, and approving all AI Content before publishing it to any platform. We expressly disclaim all liability for any consequences arising from the publication of AI-generated content, including but not limited to reputational damage, regulatory violations, or third-party claims.

6. Third-Party Platforms

The App integrates with third-party services including Meta (Instagram and Facebook). Your use of those platforms is governed by their own terms of service and privacy policies, over which we have no control.

Beyond Relations LTD is not affiliated with, endorsed by, or in any way officially connected to Meta Platforms, Inc., Instagram, or Facebook. We are not responsible for any actions taken by third-party platforms, including account suspension, content removal, reach limitations, or changes to their APIs or policies.

We make no guarantee that third-party integrations will remain available, function correctly, or continue to be supported at any time.

7. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. BEYOND RELATIONS LTD AND ITS DIRECTOR YASIN UYSAL EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED AVAILABILITY.

We do not warrant that the App will be error-free, that defects will be corrected, that the App or the servers that make it available are free of viruses or other harmful components, or that the App will meet your requirements.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BEYOND RELATIONS LTD, ITS DIRECTOR YASIN UYSAL, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Beyond Relations LTD, its director Yasin Uysal, officers, employees, agents, and partners from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any content you publish to third-party platforms using the App.

10. Acceptable Use

You agree not to use the App to generate, store, or publish content that is unlawful, defamatory, obscene, harmful, threatening, or that infringes the rights of any third party. You agree not to use the App for any purpose that violates applicable laws or regulations in your jurisdiction.

We reserve the right to remove any content and terminate any account that we determine, in our sole discretion, violates these Terms or is otherwise harmful to users, third parties, or the Company.

11. Intellectual Property

All rights, title, and interest in and to the App, including its design, code, features, and branding, are and remain the exclusive property of Beyond Relations LTD. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our express written consent.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. If we make material changes, we will update the effective date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beyond Relations LTD regarding the use of the App and supersede all prior agreements, understandings, and representations.
